Terms of Use

These Terms govern the use of the PhotoCarbs app and the photocarbs.io website, operated by KPTSIMPLE TECNOLOGIA E MARKETING LTDA, CNPJ 13.609.272/0001-35 (“we”). By creating an account or using the app, you declare that you have read and agree to these Terms and to the Privacy Policy.

Persons under 18 must use the app with the knowledge and supervision of a legal guardian. The app is not directed at children under 13.

PhotoCarbs uses artificial intelligence to estimate the carbohydrates in a meal from a photo. You review the result, can edit it and save it to a history. The app also lets you log blood glucose, import readings from compatible devices and track daily goals. Available features may vary depending on the app version, the platform and the country.

PhotoCarbs is a support tool and is not a diagnostic or treatment device. Nothing in the app or on the website replaces the assessment, diagnosis or guidance of a healthcare professional. Decisions about diet, medication and insulin are always yours, together with your healthcare team.

In an emergency, such as severe hypoglycemia or hyperglycemia, seek medical care immediately. Do not use the app to decide on emergency measures.

Carbohydrate estimates are approximations and may contain errors, especially with mixed dishes, portions that are hard to see, low-quality photos or uncommon foods. You are responsible for reviewing, adjusting or discarding each result before using it. We do not guarantee accuracy, completeness or fitness for any particular purpose.

Where available in your country and when you yourself enter your insulin-to-carbohydrate ratio, the app divides the estimated carbohydrates by that ratio and shows the formula used. This result is a transparent calculation using parameters entered by you.

• The app does not recommend which ratio to use, does not recommend doses and does not change your treatment plan.
• The app does not correct blood glucose and does not control insulin pumps or other devices.
• The dose you actually take is your decision; the app records separately the calculated value and the value you enter as taken.
• Always review the calculation and confirm the parameters with your healthcare professional.

The app may import glucose readings from third-party services, such as LibreLinkUp, using the credentials you provide. You must have the right to access those accounts and comply with the terms of those services. PhotoCarbs has no partnership with, affiliation with or endorsement from Abbott, Dexcom or any manufacturer; brands are mentioned only to indicate compatibility. These services may change or stop working without notice, which may affect data import.

• Provide truthful information and keep your password secure.
• You are responsible for the activities carried out on your account.
• Notify us at operations@kptsimple.com if you suspect unauthorized use.

The following are prohibited: using the app for unlawful purposes; uploading content that you do not have the right to upload; attempting to circumvent limits, security or access controls; reverse engineering, automated mass extraction (scraping) or overloading the infrastructure; or using the app as a substitute for medical care.

The photos and data you upload remain yours. You grant us a limited, non-exclusive license solely to operate the app: process the photos with AI, store your history and provide the features you use, in accordance with the Privacy Policy. The software, the PhotoCarbs brand, the logos and the content of the app and the website belong to us or our licensors and may not be copied or reused without authorization.

We strive to keep the app available, but it may be subject to interruptions, maintenance or changes to features, usage limits and availability by country. We may update these Terms; material changes will be communicated in the app, and continued use indicates agreement with the updated version.

The app is provided “as is”. To the maximum extent permitted by applicable law, we are not liable for decisions made based on the app's estimates or calculations, for the unavailability of third-party services, or for indirect damages. Nothing in these Terms excludes rights that the law guarantees to consumers, including the Brazilian Consumer Protection Code (Código de Defesa do Consumidor), where applicable.

You may delete your account at any time at Preferences → Account → “Delete account”, or by email, as set out in the Privacy Policy. We may suspend or terminate accounts that violate these Terms.

These Terms are governed by Brazilian law. For consumers, the venue of the consumer's domicile is elected; in all other cases, the courts of the judicial district where KPTSIMPLE TECNOLOGIA E MARKETING LTDA has its registered office.
